Danticat’s article reveals a shocking trend in the immigration system in the United States. The country has had a long history of draconian immigration laws that subject thousands of immigrants to cruelty and mistreatment in the detention system. This claim is evident in the case of the 81-year-old Joseph who succumbed to an illness following his detention and subsequent denial of the right to medication (Danticat 1). Despite having a valid passport and visa, Joseph joined a growing list of people who have been detained and died due to poor detention conditions. Perhaps, it is against this backdrop that the Smith-led House Judiciary Committee sat to hear new guidelines on immigration. Will the new guidelines provide redress to a failing immigration system? Already, Mr. Smith’s attitude towards immigration is negative. Danticat reveals that Mr. Smith feels that the United States is giving immigrants a preferential treatment (Danticat 1). This treatment encompasses safe water, off-site medication and opportunities for recreation. It is not likely that Mr. Smith can preside over fair immigration policy hearings because of his Republican leaning and repugnant attitude towards immigrants. The new guidelines are fair because they do not provide jail-like detention for minors, people with disabilities and pregnant women. They also prohibit immigration staff from carrying out strip searches on detainees of the opposite sex (Danticat 1). Other changes include access to medical care, recreation and safe water. The new guidelines symbolize a significant departure from the old draconian laws governing immigration. The immigration and customs enforcement (ICE) should embrace the guidelines and implement them in totality to ensure that immigrants get the dignity they deserve. The ruling by the Supreme Court in May 2010 failed to hold public health officials in the detention accountable for gross violations of the rights of detainees to medication. This ruling should be reviewed to ensure promote accountability for detention officials and ensure consistency with the new guidelines. Failure to overhaul legal and policy barriers would make the new guidelines a political stunt.
